Quand la toile porte l’étoile : L’Internet au service de la Charte internationale des droits de l’homme

Le réseau Internet a probablement causé un tourbillon économique et social sans équivalent dans l’histoire du monde moderne. De tels bouleversements ont amené plusieurs personnes à s’interroger sur la puissance de cet outil, sa liberté et son impact sur l’humanité. Nombreux sont ceux qui ont ainsi voulu attribuer à l’Internet un rôle primordial dans l’ensemble des maux de notre siècle, notamment en l’accusant de favoriser la propagation des messages de haine, la perversion des mœurs et le contournement de la loi. L’auteur se propose ici de prendre le contre-pied de ce courant pessimiste, et de faire la démonstration des avancées considérables que cet outil merveilleux a permises dans le domaine des droits économiques et sociaux. En s’appuyant sur les textes internationaux ayant donné naissance à ces droits voulus pragmatiques, l’auteur précise d’abord le contenu de prérogatives qui concernent directement le quotidien de chacun, sans pour autant faire l’objet d’une réelle application. Il met ensuite en parallèle l’objectif initial recherché par le législateur international et les avancées concrètes permises par le réseau dans des domaines aussi variés que la liberté d’expression, l’accès au droit, et la participation de tous à la vie culturelle et politique de la société. Cet article est une tentative de redonner au réseau ses lettres de noblesse, et d’encourager les lecteurs à utiliser mieux encore ses fantastiques ressources.

The Internet network probably is at the source of one of the most important and brutal changes in modern History, having resulted in tremendous economic and social adaptations. Such a revolution could not take place without people fearing its consequences, and in particular pointing at the power and the freedom of the network. In this context, many commentators have pronounced the Web guilty of some of the worst plagues of our century, notably because of its potential to facilitate the diffusion of messages conveying hatred, contempt of the Law and encouragement of deviant behaviors. The author takes upon himself to counter this pessimistic view, and to demonstrate that considerable progress was made thanks to this fantastic tool regarding practical application of economical and social rights. Trying to capture the essence of same rights as described in international declarations that often remained without concrete effects, he then compares the primary objective of the international legislator with real improvements which occurred in various fields comprising freedom of expression, access to Law, and participation of everyone into the cultural and political life of societies all around the globe. This article is an attempt at acknowledging the benefits that can be gained of the network, and at encouraging societies to go even further in its applications.
