Kunnan ympäristönsuojelumääräykset case Kotka

Ympäristönsuojelulain (86/2000) 19 §:n nojalla kunnilla voi olla ympäristönsuojelumääräykset. Määräysten antaminen on kunnille vapaaehtoista. Määräysten tulee olla ympäristönsuojelulain täytäntöönpanon kannalta tarpeellisia, kunnan paikallisista olosuhteista johtuvia kuntaa tai sen osaa koskevia yleisiä määräyksiä. Määräykset antaa kunnanvaltuusto. Ympäristönsuojelumääräyksillä on muuta lainsäädäntöä täydentävä, ei korvaava asema. Tämän työn tavoitteena oli laatia Kotkan kaupungille ehdotus kunnan ympäristönsuojelumääräyksiksi. Työn teoriaosassaon selvitetty kunnan ympäristönsuojelumääräysten oikeudelliset lähtökohdat ja suhde muuhun lainsäädäntöön. Tulososassa on selvitetty mitä toimintoja Kotkassa tulisi säännellä kunnan ympäristönsuojelumääräyksin. Työn toimeksiantajan kannalta oleellisimmat tulokset on esitetty työn liiteosassa. Ehdotuksen määräykset koskevat jätevesien käsittelyä, lumenkaatopaikkojen aiheuttamia ympäristöhaittoja, pölyn torjuntaa, tilapäisen melun torjuntaa, öljysäiliöiden tarkastamista ja käytöstä poistamista sekä hevosten pidon ympäristövaikutuksia. Ympäristönsuojelumääräysten voimaantulon myötä osa ympäristönsuojeluviranomaisen antamista suosituksista saa sitovan vaikutuksen. Ympäristönsuojelumääräykset osaltaan selventävät ympäristönsuojeluviranomaisen mahdollisuuksia puuttua eri toimintojen ympäristövaikutuksiin ennakolta.

Under section 19 of Environmental Protection Act municipals may have environmental protection regulations. Regulations are a voluntary way of regulating. Regulations must be issued for the purpose of implementing Environmental Protection Act and on the basis of local circumstances. Regulations may concern the entire municipality or a part of it. Municipal environmental protection regulations are issued by a municipal council. Regulations complement other existing legislation, they do not replace it. The aim of the thesis was to frame a proposal of the municipal environmental protection regulations for the city ofKotka. The theory part of the thesis consists of the juridical basis of the municipal environmental protection regulations and their relations to other legislation. The finding part focuses on such functions of which would be needful to include to the municipal environmental protection regulations. The crucial points for the city of Kotka are condensed in the appendices. The regulations of the proposal consists of waste water treatment, snow landfills, the abatement of dust, the abatement of temporary noise, the control and decommission of under ground oil tanks and the environmental impacts of horse paddock. When these regulations have issued some of the recommendations of the municipal environmental protection committee will gain the conclusive impact. Regulations clarify the possibilities of municipal environmental protection committee to interact environmental impacts of the different function beforehand.
