La protecció de la part feble del contracte en el dret civil català i en el dret civil europeu

La investigación analiza si, con el horizonte del Libro Sexto del Código Civil de Cataluña relativo a las obligaciones y los contratos, el legislador catalán tiene que mantener el modelo tradicional de la rescisión por lesión ultradimidium, o bien tiene que integrar esta institución en el marco de la protección de la parte débil del contrato, en la línea de las modernas propuestas de derecho europeo.

The research examines whether, with the outlook of the Sixth Book on the Civil Code of Catalonia regarding obligations and contracts, the Catalan legislator must uphold the traditional model of termination due to laesio ultra dimidium, or whether he or she must include this institution within the framework of protection of the weak party to the contract, in line with modern proposals of European law.
