O Conceito de Autarquias Locais na Constituição da República de Angola: o caso do Município

Com a presente dissertação procurou-se definir qual a configuração Constitucional do conceito de Autarquias locais na República de Angola, o caso do Município, analisando o processo de reforma administrativa estudando, do ponto de vista jurídico, o novo figurino administrativo do país tendo em conta a implementação da Autarquias Locais. O primeiro passo foi compreender a evolução do conceito de municípios nos vários estádios do seu desenvolvimento histórico, usando, sempre que possível, uma abordagem histórica e jurídica. O segundo passo foi procurar entender a configuração do Poder Local na Constituição da República da Angola. Neste caso, tentamos fazer uma aproximação sistemática a fim de entender o verdadeiro alcance daquilo que a Constituição denomina, expressivamente, de “Poder Local (Título VI CRA) ”. Finalmente concentramos o foco da análise na incidência futura da implementação das autarquias locais nos actuais municípios, tendo concluído que embora a CRA tenha prestado uma levada atenção ao enunciar os princípios conducentes a implementação das autarquias, a legislação ordinária e a regulamentação ainda não estão devidamente alinhadas com os princípios constitucionais existindo um longo caminho a percorrer nomeadamente com a realização de eleições locais e institucionalização das respectivas autarquias onde o actual modelo administrativo deverá evoluir para o novo modelo de administração autárquica.

With this thesis we tried to define the configuration of the Constitutional concept of Local Authorities in the Republic of Angola, the case of the municipality, analyzing the process of administrative reform studying, from a legal point of view, the new administrative stage costume of the country taking into account the implementation of the Local Authorities. The first step was to understand the evolution of the concept of municipalities in various stages of its historical development, using, whenever possible, a historical and legal approach. The second step was seek to understand the configuration of Local Government in the Constitution of the Republic of Angola. In this case, try to make a systematic approach in order to understand the true scope of what the Constitution denominates, expressively, for "Local Government (Title VI CRA)". Finally concentrated the focus of analysis in the future incidence of local government implementation in the current municipalities and concluded that although the CRA has rendered a naughty attention to in outline the principles on setting up municipalities, ordinary legislation and regulations are not yet adequately in line with the constitutional principles and there is a long way to go especially with the local elections and institutionalization of the respective local authorities where the current administrative model will evolve into the new model of local government.
