As apostas desportivas online associadas à combinação de resultados

The present dissertation is aimed at finding out whether the existing criminal protection of the sports ethics value is sufficient, regarding the dangers arising from the global online sports betting market and its characteristics. In the first chapter, the main issue will be introduced: the association between online sports bets and competition manipulations from a criminal point of view. In the second chapter, online sports bets will be defined, the characteristics of the referred global market explained and the danger said features bear to the manipulation of sports competitions exposed – also analysing the participants in this phenomenon. In chapter 3, it will be shown that the protection of sports ethics is a matter of public interest and that this interest is carried out by the sports federations as well. In the fourth chapter, the focus will be the criminal protection of sports ethics: its necessity based on the penal dignity of this system of sport associated values; the need to re-evaluate the existing protection due to the recognition of the existence of the online sports betting market; the existing criminal norms regarding the manipulation of sports competitions. Finally, in chapter 5, the intent will be to propose solutions to the identified problems concerning the sufficiency of the existing criminal legislation.

Na presente dissertação pretende-se verificar a suficiência, para assegurar a protecção da ética desportiva, dos regimes penais existentes que visam combater a combinação de resultados face aos perigos colocados pela existência de um mercado global de apostas desportivas online. No capítulo 1, introduzir-se-á o tema da associação entre apostas desportivas online e combinação de resultados, do ponto de vista penal. No capítulo 2, analisar-se-á o conceito de aposta desportiva (à cota) online, as características do mercado global com estas relacionado e os perigos que dessas características decorrem, para a ética desportiva, quando conjugadas com a manipulação da competição desportiva, passando pela identificação dos intervenientes na combinação. No capítulo 3, proceder-se-á à demonstração da existência de um interesse público quanto à protecção da ética desportiva, sendo necessária a parceria com as federações desportivas para assegurar a sua correcta prossecução. No capítulo 4, falar-se-á da protecção penal da ética desportiva: da necessidade de tutela criminal, assente na dignidade deste bem; da necessidade de reapreciar a protecção que existe face ao reconhecimento do mercado de apostas desportivas online; da resposta penal que existe actualmente quanto à punição da combinação de resultado (passando pela verificação da sua adequação), à qual se seguirá, no capítulo 5, por fim, a averiguação da sua suficiência e respectivas propostas para solucionar os problemas identificados.
