O Ministério Público e o plano diretor: propostas de acompanhamento sob a perspectiva da democracia participativa

Neste trabalho procurou-se defender um papel democrático para o Ministério Público no acompanhamento do plano diretor, tendo como orientação a teoria da democracia participativa. Em primeiro lugar, foi pesquisada a história do uso do plano diretor no Brasil, considerada bastante problemática. A inclusão do plano diretor na Constituição de 1988, que lhe atribuiu o importante papel de delimitar a função social da propriedade urbana, impulsionou a pesquisa a buscar uma função democrática para ele, afastando-o de sua história simbólica. Nesse sentido, a democracia participativa mostra-se fundamental no estabelecimento de um novo perfil para o plano diretor. Por outro lado, o Ministério Público também ganhou importância após a Constituição de 1988, incumbindo-lhe, entre outras funções, a defesa do regime democrático o que inclui também a democracia participativa. É necessário, porém, fixar a legitimidade democrática da instituição para além dos dispositivos da Constituição. Uma das possibilidades é tentar aplicar-lhe os argumentos que procuram justificar democraticamente a jurisdição constitucional. Da mesma forma, esta legitimidade pode ser encontrada com o envolvimento das demandas da sociedade na atuação do Ministério Público. Finalmente, o trabalho escolheu as audiências públicas para avaliação dos mecanismos de participação e da atuação do Ministério Público no reforço da democracia participativa. A pesquisa encerra-se com um estudo de caso emblemático (o Plano de Preservação do Conjunto Urbanístico de Brasília PPCUB), em que foram investigados a participação popular e o papel do Ministério Público local.

This work tried to defend a democratic role for the State Attorney in the process of the municipal master plans, using the theory of participatory democracy. The research begins with an overview of the history of master plans in Brazil, which was considered quite problematic. The Brazilian 1988 Constitution included the use of master plan, assigning to it the important role of establishing the social function to the urban property. Because of that, the research pursued a democratic function for this urban plan, moving it away from its symbolic history. In this regard, the participatory democracy reveals itself fundamental in the establishment of a new profile for the master plan. On the other hand, the State Attorney also acquired importance after the 1988 Constitution, having, among other functions, the responsibility to defend the democratic regime including a participatory democracy. However, it is necessary to determine the State Attorneys democratic legitimacy beyond the articles of the Constitution. For instance, applying the theories that try to democratically justify the constitutional jurisdiction. Similarly, this legitimacy can be found on the coordination of the institutions action with the societys demands. Finally, the work chose the public hearings to evaluate the participatory apparatus and the State Attorney performance on the reinforcement of participatory democracy. The research concludes with an emblematic case study (the Brasília Urban Compound Preservation Plan), which examined the popular participation and the role of the local State Attorney.
