Los mercados asociados a los servicios de voz móvil a móvil, brindados por operadoras del Sistema Móvil Avanzado en Latinoamérica, han estado sujetos a procesos regulatorios motivados por la dominancia en el mercado de un operador, buscando obtener óptimas condiciones de competencia. Específicamente en Ecuador, la Superintendencia de Telecomunicaciones (Organismo Técnico de Control de Telecomunicaciones) desarrolló un modelo para identificar acciones de regulación que puedan proporcionar al mercado efectos sostenibles de competencia en el largo plazo. Este artículo trata sobre la aplicación de la ingeniería de control para desarrollar un modelo integral del mercado, empleando redes neuronales para la predicción de trarifas de cada operador y un modelo de lógica difusa para predecir la demanda. Adicionalmente, se presenta un modelo de inferencia de lógica difusa para reproducir las estrategias de mercadeo de los operadores y la influencia sobre las tarifas. Dichos modelos permitirían la toma adecuada de decisiones y fueron validados con datos reales.

Teachers of construction economics and estimating have for a long time recognised that there is more to construction pricing than detailed calculation of costs (to the contractor). We always get to the point where we have to say "of course, experience or familiarity of the market is very important and this needs judgement, intuition, etc". Quite how important is the matter in construction pricing is not known and we tend to trivialise its effect. If judgement of the market has a minimal effect, little harm would be done, but if it is really important then some quite serious consequences arise which go well beyond the teaching environment. Major areas of concern for the quantity surveyor are in cost modelling and cost planning - neither of which pay any significant attention to the market effect. There are currently two schools of thought about the market effect issue. The first school is prepared to ignore possible effects until more is known. This may be called the pragmatic school. The second school exists solely to criticise the first school. We will call this the antagonistic school. Neither the pragmatic nor the antagonistic schools seem to be particularly keen to resolve the issue one way or the other. The founder and leader of the antagonistic school is Brian Fine whose paper in 1974 is still the basic text on the subject, and in which he coined the term 'socially acceptable' price to describe what we now recognise as the market effect. Mr Fine's argument was then, and is since, that the uncertainty surrounding the contractors' costing and cost estimating process is such that the uncertainty surrounding the contractors' cost that it logically leads to a market-orientated pricing approach. Very little factual evidence, however, seems to be available to support these arguments in any conclusive manner. A further, and more important point for the pragmatic school, is that, even if the market effect is as important as Mr Fine believes, there are no indications of how it can be measured, evaluated or predicted. Since 1974 evidence has been accumulating which tends to reinforce the antagonists' view. A review of the literature covering both contractors' and designers' estimates found many references to the use of value judgements in construction pricing (Ashworth & Skitmore, 1985), which supports the antagonistic view in implying the existence of uncertainty overload. The most convincing evidence emerged quite by accident in some research we recently completed with practicing quantity surveyors in estimating accuracy (Skitmore, 1985). In addition to demonstrating that individual quantity surveyors and certain types of buildings had significant effect on estimating accuracy, one surprise result was that only a very small amount of information was used by the most expert surveyors for relatively very accurate estimates. Only the type and size of building, it seemed, was really relevant in determining accuracy. More detailed information about the buildings' specification, and even a sight to the drawings, did not significantly improve their accuracy level. This seemed to offer clear evidence that the constructional aspects of the project were largely irrelevant and that the expert surveyors were somehow tuning in to the market price of the building. The obvious next step is to feed our expert surveyors with more relevant 'market' information in order to assess its effect. The problem with this is that our experts do not seem able to verbalise their requirements in this respect - a common occurrence in research of this nature. The lack of research into the nature of market effects on prices also means the literature provides little of benefit. Hence the need for this study. It was felt that a clearer picture of the nature of construction markets would be obtained in an environment where free enterprise was a truly ideological force. For this reason, the United States of America was chosen for the next stage of our investigations. Several people were interviewed in an informal and unstructured manner to elicit their views on the action of market forces on construction prices. Although a small number of people were involved, they were thought to be reasonably representative of knowledge in construction pricing. They were also very well able to articulate their views. Our initial reaction to the interviews was that our USA subjects held very close views to those held in the UK. However, detailed analysis revealed the existence of remarkably clear and consistent insights that would not have been obtained in the UK. Further evidence was also obtained from literature relating to the subject and some of the interviewees very kindly expanded on their views in later postal correspondence. We have now analysed all the evidence received and, although a great deal is of an anecdotal nature, we feel that our findings enable at least the basic nature of the subject to be understood and that the factors and their interrelationships can now be examined more formally in relation to construction price levels. This dissertation is a conjunction of three essays on the Industrial Organization field, this empirical work is applied to the Brazilian retail gasoline market. The first essay investigates the existence of spillover effects from cartel activity. The second essay relates the well-known economic puzzle of asymmetric cost pass through to prices with the existence of horizontal coordination - cartels - in the relevant market. Finally, the third essay investigates the effectiveness of antitrust interventions inside the offenders and the consequences of its disclosure in related markets.

The Spanish economy is slightly showing positive recovery signs. Construction figures and domestic consumption, which are the most relevant market drivers for forest products, are also significantly better than in the last years. This article analyzes the projections for 2015 in several forest products markets. The conclusion is that a certain general improvement can be expected in most of them, though showing different figures and values.

Em 1999, o mercado de medicamentos genéricos foi criado no Brasil. Com isso, iniciou-se uma nova fase do mercado farmacêutico brasileiro. Através de dados cedidos pela ANVISA sobre o mercado varejista brasileiro, objetivou-se testar em até que ponto a política de medicamentos genéricos tem logrado êxito. Foram utilizados dados em painel para analisar o impacto da entrada dos medicamentos genéricos sobre a estrutura do mercado, assim como o impacto nos preços e na quantidade vendida entre 2003 e 2007. Os resultados foram favoráveis à diminuição da concentração dos mercados relevantes da amostragem e também ao aumento da quantidade comercializada. Em relação aos preços, o modelo se mostrou pouco significativo, provavelmente pela política de medicamentos genéricos ser um instrumento indireto de controle de preços. De qualquer forma, os resultados encontrados parecem sugerir o bom andamento da política de medicamentos genéricos, o que é um alívio em se tratando de um mercado tão essencial para o bem-estar da população.

A pesquisa analisa a validade da cláusula de raio no aspecto do direito civil-empresarial (privado) e da concorrência (público). No âmbito do direito civil-empresarial analisa-se a cláusula de raio em conjunto com a cláusula de aluguel percentual e possível lesão à boa-fé objetiva. No aspecto do direito da concorrência é analisado o mercado relevante na dimensão produto e geográfica, bem como as externalidades positivas e negativas produzidas pela cláusula de raio. Para a realização da pesquisa adota-se o método dedutivo, realizado a partir de pesquisa bibliográfica e jurisprudencial sobre o tema. Traz como resultado os parâmetros que devem ser utilizados para a análise da cláusula de raio e a hipótese em que ela pode ser prevista.

This thesis consists of a summary and five self-contained papers addressing dynamics of firms in the Swedish wholesale trade sector. Paper [1] focuses upon determinants of new firm formation in the Swedish wholesale trade sector, using two definitions of firms’ relevant markets, markets defined as administrative areas, and markets based on a cost minimizing behavior of retailers. The paper shows that new entering firms tend to avoid regions with already high concentration of other firms in the same branch of wholesaling, while right-of-the-center local government and quality of the infrastructure have positive impacts upon entry of new firms. The signs of the estimated coefficients remain the same regardless which definition of relevant market is used, while the size of the coefficients is generally higher once relevant markets delineated on the cost-minimizing assumption of retailers are used. Paper [2] analyses determinant of firm relocation, distinguishing between the role of the factors in in-migration municipalities and out-migration municipalities. The results of the analysis indicate that firm-specific factors, such as profits, age and size of the firm are negatively related to the firm’s decision to relocate. Furthermore, firms seems to be avoiding municipalities with already high concentration of firms operating in the same industrial branch of wholesaling and also to be more reluctant to leave municipalities governed by right-of-the- center parties. Lastly, firms seem to avoid moving to municipalities characterized with high population density. Paper [3] addresses determinants of firm growth, adopting OLS and a quantile regression technique. The results of this paper indicate that very little of the firm growth can be explained by the firm-, industry- and region-specific factors, controlled for in the estimated models. Instead, the firm growth seems to be driven by internal characteristics of firms, factors difficult to capture in conventional statistics. This result supports Penrose’s (1959) suggestion that internal resources such as firm culture, brand loyalty, entrepreneurial skills, and so on, are important determinants of firm growth rates. Paper [4] formulates a forecasting model for firm entry into local markets and tests this model using data from the Swedish wholesale industry. The empirical analysis is based on directly estimating the profit function of wholesale firms and identification of low- and high-return local markets. The results indicate that 19 of 30 estimated models have more net entry in high-return municipalities, but the estimated parameters is only statistically significant at conventional level in one of our estimated models, and then with unexpected negative sign. Paper [5] studies effects of firm relocation on firm profits of relocating firms, employing a difference-in-difference propensity score matching. Using propensity score matching, the pre-relocalization differences between relocating and non-relocating firms are balanced, while the difference-in-difference estimator controls for all time-invariant unobserved heterogeneity among firms. The results suggest that firms that relocate increase their profits significantly, in comparison to what the profits would be had the firms not relocated. This effect is estimated to vary between 3 to 11 percentage points, depending on the length of the analyzed period.

The new Australian cartel laws prohibit a provision of a contract, arrangement or understanding that inter alia, results in price fixing and output restriction between competitors in the relevant market. This is subject to a recognition that sometimes such conduct can be in the public interest, in which case the Australian Competition and Consumer Commission (ACCC) may grant an authorisation. One such instance may be an activity characterised by substantial externalised cost. An authorisation application would need to provide suitable evidence in support of the underlying case being argued. Traditionally in Australia, such evidence has been qualitative in nature; however, where possible, the ACCC and its counterparts in the EU and New Zealand encourage quantitative estimates. This is a case study of the welfare impact of output restrictions in the Australian beer industry, which is a source of substantial negative externalities. A standard simulation exercise is utilised as an example of how applicants and the competition regulator might combine theoretical and quantitative concepts to better achieve the objectives of the new legislation.

Esta dissertação objetiva compreender como a entrada da companhia no mercado de retail Norte Americano poderia contribuir com sua estratégia. Acredita-se que sendo o mercado Norte Americano o maior consumidor e também importador mundial de gasolina (derivado de petróleo de alto valor agregado) este seria um mercado relevante para a expansão dos negócios da Petrobras. Dentre as principais razões destacamos: o tamanho deste mercado consumidor, vantagens logísticas, margens atrativas, diversificação do portfólio da companhia e; um posicionamento estratégico no sentido de ser reconhecida internacionalmente. Dentre os resultados desta dissertação pode-se destacar que o mercado de downstream norte americano é atrativo e, assim sendo, a Petrobras, como companhia de petróleo regional objetivando tornar-se uma grande empresa internacional de petróleo, deva estudar a possibilidade de entrar no mercado de retail norte americano. Não foram detectadas barreiras suficientemente fortes no que tange ao comportamento predatório nem custos afundados ou integração vertical que impeça a entrada de novos competidores. Finalmente, ao observar-se os resultados da fronteira eficiente, tem-se que não existe uma “melhor” opção de carteira e, caberá a companhia definir o quão exposto ao risco deseja estar e, ao mesmo tempo, qual o retorno mínimo aceitável.

Este trabalho analisa o setor brasileiro de celulose e tenta responder a duas questões principais: a abrangência do mercado relevante e a existência de poder de mercado das empresas que atuam neste setor. A dimensão produto do mercado relevante foi definida a partir de dados qualitativos. Devido à indisponibilidade de dados para uma análise qualitativa mais apurada, a opção foi pela celulose de fibra curta de eucalipto, produto mais importante do setor, tanto pela posição brasileira em tecnologia como pela pauta de exportações. Já quanto à dimensão geográfica, o procedimento realizado baseou-se em Forni (2004) que utiliza testes de raiz unitária para a definição do mercado. Concluiu-se que, com os dados disponíveis, o mercado deste produto pode ser considerado como internacional, não somente pelo resultado do teste como também pelo modo de funcionamento deste mercado. Definido o mercado de produto e geográfico, realizou-se um teste de poder de mercado, pois neste nicho, a Aracruz é líder mundial. Tal teste foi realizado com base na demanda residual descrita por Mayo, Kaserman e Kahai (1996) e estimado segundo Motta (2004). Concluiu-se que, apesar de a Aracruz possuir um elevado market share no setor, ela não possui poder de mercado.

O objetivo deste trabalho é caracterizar o padrão de concorrência no mercado de leite fluido (longa vida e pasteurizado) na cidade de São Paulo a partir de evidências sobre os movimentos de preços no varejo e do comportamento das margens de mercado. Utilizou-se o modelo originalmente proposto por Houck (1977) acrescido das observações feitas por Carman e Sexton (2005). Essa abordagem separa as variáveis explicativas entre aumentos e diminuições de preços pagos ao produtor. Além de maior clareza na sua estrutura, essa construção permite comparar a defasagem entre esses dois movimentos e estudar a estratégia de preços dos agentes a partir das margens dos intermediários. O período analisado foi de dezembro de 1999 à dezembro de 2005, com dados de preços ao consumidor da FIPE e dados de preços ao produtor da CEPEA/ USP. Identificou-se que o padrão de concorrência do leite longa vida é bastante diverso do encontrado para o leite pasteurizado. Enquanto para o longa vida o padrão de concorrência é mais próximo do modelo competitivo, para o leite pasteurizado o padrão encontrado foi de pouca concorrência. Para compreender essas diferenças, foi discutido o aspecto locacional do varejo e a importância do mercado relevante geográfico. Os resultados permitem algumas inferências para análises setoriais e de políticas públicas voltadas à produção leiteira. O vertiginoso crescimento das vendas de leite longa vida, absorvendo grande parte do mercado antes abastecido pelo leite pasteurizado, trouxe maior concorrência nos segmentos de indústria e distribuição, assim como maior velocidade de transmissão de preços ao longo da cadeia produtiva. Entretanto, a precificação com markups com percentual fixo, observada no leite longa vida, indica que indústria e distribuição gozam de algum poder de mercado e que variações de custo da matéria-prima são repassadas mais que proporcionalmente, em termos absolutos, ao consumidor final.

We address specific problems to be considered once the Protocolo de Fortaleza becomes a fully recognised agreement. Elimination of anti-dumping measures a la WTO, services competition and the interrelationship between the regulatory agencies and the competition offices, issues regarding the concept of relevant market and, in a broader view, harmonisation of rules, criteria, institutions and regional competitive environments, are discussed. The European experience, if properly adapted, can be of value. In this context, two important principles are singled-out: acknowledgement of an acquis Mercosul – which allows a realistic and constructive perspective when facing the integration challenges, and the wise use of subsidiarity, for faster developments with lighter central institutions. Dispute settlement, in the competition framework, is not tackled, though – in this case – we are favourable to the creation of a supranational organism. All these points do not naturally encompass everything required for the full implementation of a competition policy in Mercosul.
