Ressocialização no meio prisional

This paper examine the purpose of rehabilitation while main purpose of imprisonment application, and the divergence between its central role assumed in legislation and what is being practiced in the institutional dimension. This study aims to determine the expected outcome of this dialectical opposition, in pursuit of preventive purposes that guide the criminal reactions of Portuguese criminal - legal system. To this end, the sentence of imprisonment shall be framed in the main politico- criminal traits of our country, analyzing the standards and principles that underlie and underpin our legal – criminal system. The guiding principles of the prison sentence and the respective legislation will be presented, such as the prison system and treatment provided to achieve the above desideratum. Finally material factors and legislative contradictions that oppose the rehabilitation in prisons will be presented. The dissertation does not intend to expose the solution to this paradox insurmountable, but rather present the main factors that hinder the achievement of the objectives intended to be achieved with the prison sentence.

O presente trabalho irá analisar a ressocialização enquanto finalidade da execução da pena de prisão, e a divergência existente entre o seu papel central assumido em sede legislativa e, o que na prática se verifica na dimensão penitenciária. O presente estudo pretende determinar qual o resultado expectável desta oposição dialética, na persecução das finalidades preventivas que orientam as reações criminais determinados no sistema jurídico – penal português. Para tal, a execução da pena de prisão será enquadrada nos principais traços politico-criminais do nosso país, analisando-se as normas e princípios que fundamentam e alicerçam o nosso sistema jurídico – penal. Serão apresentados os princípios orientadores à execução da pena prisão e legislação que visa a reintegração social do delinquente, como também, o regime e tratamento prisional orientado para o referido desiderato. Finalmente serão apresentados fatores materiais e divergências legislativas que contrapõem a ressocialização no meio prisional. A dissertação não pretende expor a solução para este paradoxo insuperável, mas sim, expor os principais fatores que dificultam a concretização dos objetivos pretendidos a alcançar com a pena de prisão
