Reparación y reconocimiento a víctimas del terrorismo: prácticas restaurativas desde el punto de vista de las víctimas de ETA

[ES]En este trabajo sobre las víctimas del terrorismo de ETA se abordarán temas relacionados con su recuperación emocional y su reconocimiento, particularmente, distinguiendo entre las víctimas que han tenido experiencias de encuentro con un ex miembro de ETA, y las que no lo han tenido. En ocasiones, las instituciones públicas facilitan la oportunidad a las víctimas de participar en programas o prácticas de justicia restaurativas frente a ex victimarios, mientras que otras víctimas prefieren no participar en estas experiencias, o simplemente no tienen acceso a ellas. Partiendo del derecho que tienen las víctimas de ser reconocidas tanto en una circunstancia como en la otra, este trabajo explora si éstas cuentan con los suficientes recursos y mecanismos para hacer frente a su recuperación emocional y reconocimiento. La primera parte del trabajo está dedicada a la contextualización y conceptualización de las víctimas, sus derechos y sistema normativo, y los mecanismos de justicia restaurativa. En la segunda parte, se analizan brevemente algunas experiencias internacionales de justicia restaurativa con víctimas del terrorismo. A continuación, exploraremos el caso vasco estudiando diferentes casos de recuperación y reconocimiento en víctimas de Euskadi. Y finalmente, se muestran los resultados del trabajo de campo sobre las tres entrevistas realizadas donde víctimas y victimarios valoran experiencias de justicia restaurativa y su potencial reparador.

[EU]ETAren terrorismoaren biktimei buruzko lan honetan, biktima horien inguruko hainbat gai aztertuko ditugu; besteak beste, pertsona horiek emozionalki nola indarberritu eta beren biktima egoera nola onartu. Bi motatako biktimak bereiziko ditugu, batetik, ETAkide ohi batekin elkartzeko aukera izan dutenak eta bestetik, elkartze hori izan ez dutenak. Zenbaitetan erakunde publikoek senda-justizia bultzatzen duten egitasmo eta praktiketan parte hartzeko aukerak bideratzen dituzte, baina batzuetan biktimek nahiago izaten dute esperientzia horietan ez parte hartu, edo eta ez dute horretarako aukerarik izaten. Egoera batean edo bestean biktima guztiek aitortza jasotzeko eskubidea dutela kontuan harturik, emozionalki indarberritzeko eta dagokien aitortza jasotzeko nahikoa baliabide eta mekanismo ba ote dituzten aztertuko da lan honetan. Lanaren lehen zatia biktimen kontzeptualizazioari eta kontextualizazioari dago eskainita. Bigarren zatian, terrorismoaren biktimekin nazioartean senda-justiziaren inguruan izan diren hainbat esperientzia azalduko ditugu. Jarraian, euskal eredua aztertuko dugu Euskadiko biktimen indarberritze eta aitortza kasu desberdinetan oinarrituz. Eta azkenik, egin diren hiru elkarrizketen inguruko landa-azterketaren emaitzak azalduko ditugu. Bertan, biktimek, biktimarioek eta mediadoreek senda-justiziaren ahalmenak baloratuko dituzte.

[EN]This project about the victims of ETA will tackle matters related with their emotional recovery and their recognition. Especially, distinguishing between the victims that had the experience on meeting with members of ETA, and the ones that had not. Occasionally, the public institutions facilitate to the victims the opportunity to take part in programs or practices of restorative justice confronting ex murderers. But sometimes some of those victims prefer not to take part in those experiences, or simply they do not have access to it. Coming from the right all victims have to be recognized in both situations, this project search if those situations take into account enough resources and mechanics to confront their emotional recovery and recognition. The first part of this project shows the contextualization and conceptualization of the victims, their rights and normative system, and the mechanics of the restorative justice. In the second part, it will be analyzed shortly some international experiences of restorative justice with terrorism victims. To continue, it will be explored the Basque case studying different recognitions and recuperations of Basque victims. To finish, it will be shown the results on field work of three interviews, where victims and ex murderers assess experiences of restorative justice and its repairmen potential.
